Passuk 1,16 in Parshas Devarim states, “Listen to your brothers
and judge them with proper justice.” Chaza”l learn out from the words,
“brothers,” which is plural, that the judge cannot listen to the words
of one person before the other one comes. Rabbeinu Bachya explains
the reason behind this halacha that only if another person is
available to contradict the statements of a claimant will he be
careful to tell the truth.
