First Section – the Positive Commandments
63. It is a positive commandment to return a pledged object at the time he needs it
As it states in Devarim (Deuteronomy) 24:13, “you shall return, you shall surely return to him the pledged object.” The same law is if he obtained it from his friend through the court, or by his own hands through force, or with the knowledge of the borrower, he is still obligated to return it. He has to return a pillow during the night. He also has to return the instruments he uses to do his job or clothes he wears during the day, in the daytime for the whole day. One who transgresses this and does not return the pledge during its time has violated a positive commandment and transgressed a negative commandment (see Negative Commandment #61)
