The passuk in Parshas Pinchas tells us, “And it (inheritance) is for Bnei Yisroel a fixed law.” The Ramba”m learns from this that one cannot change the rules of yerushah, inheritance, from the laws of the Torah. In many cases, one can make a t’nai, a condition, and stipulate that the monetary law of the Torah should not apply to a particular transaction (as long as both parties agree). However, the laws of inheritance are forever and cannot be stipulated on by the deceased to give to one who is not deserving according to Torah law..>>>>>
